Dessa forma, a usucapi\u00e3o se caracteriza por ser, ao mesmo tempo, um modo de perda da propriedade, bem como um modo de aquisi\u00e7\u00e3o da propriedade ao possuidor!&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-sobre-quais-imoveis-pode-recair-a-usucapiao-nbsp\" style=\"font-style:normal;font-weight:400\"><span id=\"sobre-quais-imoveis-pode-recair-a-usucapiao\"><strong>Sobre quais im\u00f3veis pode recair a usucapi\u00e3o?&nbsp;<\/strong><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Somente sobre im\u00f3veis particulares (<strong>Art. 102 da CC e art. 191, par\u00e1grafo \u00fanico, da CF<\/strong>), uma vez que os bens p\u00fablicos n\u00e3o est\u00e3o sujeitos \u00e0 usucapi\u00e3o.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-e-possivel-a-soma-das-posses-para-fins-da-usucapiao-nbsp\" style=\"font-style:normal;font-weight:400\"><span id=\"e-possivel-a-soma-das-posses-para-fins-da-usucapiao\"><strong>\u00c9 poss\u00edvel a soma das posses para fins da usucapi\u00e3o?&nbsp;<\/strong><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Para efeito da usucapi\u00e3o \u00e9 poss\u00edvel o possuidor somar, ao seu pedido de posse, a posse dos seus antecessores. \u00c9 o que estabelece o artigo 1.243 do CC: <\/p>\n\n\n\n<pre class=\"wp-block-preformatted\">\u201cArt. 1.243. O possuidor pode, para o fim de contar o tempo exigido pelos artigos antecedentes, acrescentar \u00e0 sua posse a dos seus antecessores (art. 1.207), contanto que todas sejam cont\u00ednuas, pac\u00edficas e, nos casos do art. 1.242, com justo t\u00edtulo e de boa-f\u00e9\u201d. <\/pre>\n\n\n\n<p class=\"wp-block-paragraph\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong>Exemplo:<\/strong><\/mark> Sucessivos contratos de cess\u00e3o de direitos possess\u00f3rios.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Importante ressalvar que a soma das posses \u00e9 facultativa, pois, se ficar constatada a m\u00e1 qualidade na posse do seu antecessor, o possuidor poder\u00e1 descartar tal per\u00edodo anterior. Assim, somente a posse de igual qualidade \u00e9 que se aproveita.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-e-possivel-a-transferencia-de-posse-para-fins-de-usucapiao-nbsp\" style=\"font-style:normal;font-weight:400\"><span id=\"e-possivel-a-transferencia-de-posse-para-fins-de-usucapiao\"><strong>\u00c9 poss\u00edvel a transfer\u00eancia de posse para fins de usucapi\u00e3o?&nbsp;<\/strong><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sim, \u00e9 poss\u00edvel a transfer\u00eancia de posse de uma a outra pessoa, conforme determinado pelo artigo 1.207 do CC, em duas situa\u00e7\u00f5es:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong>a)<\/strong> <strong>neg\u00f3cio jur\u00eddico \u201cinter vivos\u201d (\u201cacessio possessionis\u201d):<\/strong><\/mark><strong> <\/strong>pois ela tem valor patrimonial. Esta n\u00e3o se aplica a todas as modalidades de usucapi\u00e3o, somente \u00e0 usucapi\u00e3o extraordin\u00e1ria, ordin\u00e1ria e a coletiva, pois as usucapi\u00f5es urbana e rural exigem posse pessoal (pr\u00f3pria), com o fim de moradia, al\u00e9m do requisito de tornar a terra produtiva com o seu trabalho, no caso da usucapi\u00e3o rural.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong>b)<\/strong> \u201c<strong>causa mortis\u201d (\u201csucessio possessionis\u201d):<\/strong><\/mark><strong> <\/strong>em que a posse se transmite automaticamente com a morte do possuidor aos seus herdeiros. \u00c9 uma posse sem comportamento, pois, muitas vezes, o herdeiro n\u00e3o teve nenhum contato com a coisa. Assim, o herdeiro \u00e9 possuidor por efeito de lei \u2013 posse jur\u00eddica da coisa<strong>. <\/strong>\u00c9 aplicado a todas as modalidades de usucapi\u00e3o.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-o-que-e-a-posse-qualificada-para-fins-da-usucapiao\" style=\"font-style:normal;font-weight:400\"><span id=\"o-que-e-a-posse-qualificada-para-fins-da-usucapiao\"><strong>O que \u00e9 a posse qualificada para fins da usucapi\u00e3o?<\/strong><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Para que se verifique a posse qualificada no per\u00edodo da prescri\u00e7\u00e3o aquisitiva para fins de usucapi\u00e3o \u00e9 necess\u00e1rio que o possuidor prove que a posse exercida apresentava as seguintes caracter\u00edsticas:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-cnvs-list-styled-positive\">\n<li><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong>posse mansa e pac\u00edfica<\/strong>:<\/mark> a posse deve ser sem oposi\u00e7\u00e3o. A oposi\u00e7\u00e3o deve ser jur\u00eddica e o modo eficaz de se opor \u00e9 atrav\u00e9s do ajuizamento de uma a\u00e7\u00e3o para a retomada da coisa \u2013 A\u00e7\u00e3o possess\u00f3ria, sendo que somente poder\u00e1 se opor \u00e0 posse quem tem legitimidade para tanto (aquele que ir\u00e1 perder a coisa pela usucapi\u00e3o). Exemplos: confrontantes, titulares de direito real, propriet\u00e1rio.&nbsp;<\/li>\n\n\n\n<li><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong>posse cont\u00ednua<\/strong>: <\/mark>a posse deve ser sem interrup\u00e7\u00f5es;<\/li>\n\n\n\n<li><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong>posse com \u201canimus domini\u201d<\/strong> <strong>(Art. 1.238, <em>caput<\/em>, do CC): <\/strong><\/mark>&nbsp;o possuidor deve possuir a coisa como se fosse sua;<\/li>\n\n\n\n<li><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong>posse de boa-f\u00e9 (Art. 1201, \u201ccaput\u201d, do CC)<\/strong>:<\/mark> \u00c9 a boa-f\u00e9 subjetiva (boa-f\u00e9 ignor\u00e2ncia), em que se desconhecem os v\u00edcios da posse. Art. 1.201. \u00c9 de boa-f\u00e9 a posse, se o possuidor ignora o v\u00edcio, ou o obst\u00e1culo que impede a aquisi\u00e7\u00e3o da coisa.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-quais-sao-as-modalidades-de-usucapiao-nbsp\" style=\"font-style:normal;font-weight:400\"><span id=\"quais-sao-as-modalidades-de-usucapiao\"><strong>Quais s\u00e3o as modalidades de usucapi\u00e3o?&nbsp;<\/strong><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">S\u00e3o<strong> 7 (sete) as modalidades da usucapi\u00e3o<\/strong>, quais sejam:  extraordin\u00e1ria,  ordin\u00e1ria, especial urbana, especial rural, coletiva, especial ind\u00edgena e conjugal.<\/p>\n\n\n\n<div class=\"wp-block-group is-style-default cnvs-block-core-group-1754791346433\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"has-vivid-red-background-color has-background wp-block-paragraph\" style=\"font-size:18px\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-white-color\">Usucapi\u00e3o extraordin\u00e1ria<\/mark><\/strong><\/p>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-style-cnvs-block-bg-light\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"wp-block-paragraph\">\u00c9 aquela modalidade de usucapi\u00e3o cujo <strong>prazo para a prescri\u00e7\u00e3o aquisitiva \u00e9 maior<\/strong>, <strong>podendo chegar a 15 anos<\/strong> e se encontra no artigo 1.238 do C\u00f3digo Civil.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Requisitos:&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>a) Prazo: <\/strong>15 anos;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>b) Posse<\/strong>: cont\u00ednua, mansa, pac\u00edfica e com \u201canimus domini\u201d;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>c) <\/strong>O prazo pode ser reduzido para 10 anos<strong> <\/strong>&#8211; Art. 1.238, par\u00e1grafo \u00fanico, do CC: Posse-trabalho. \u00c9 a usucapi\u00e3o com posse socialmente qualificada, desejada, raz\u00e3o pela qual a lei reduz o prazo para 10 anos. O possuidor, nesse caso, promove a fun\u00e7\u00e3o social da propriedade, uma vez que, al\u00e9m de us\u00e1-la como sua moradia, tamb\u00e9m faz servi\u00e7os ou obras de natureza relevante (produtiva).&nbsp;<\/p>\n<\/div><\/div>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-group is-style-default cnvs-block-core-group-1754791485283\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"has-vivid-red-background-color has-background wp-block-paragraph\" style=\"font-size:18px\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-white-color\">Usucapi\u00e3o ordin\u00e1ria<\/mark><\/strong><\/p>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-group is-style-default\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-style-cnvs-block-bg-light\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"wp-block-paragraph\">Ela possui disposi\u00e7\u00e3o expressa no artigo 1.242 do C\u00f3digo Civil.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Requisitos: <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>a) Prazo: <\/strong>10 anos;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>b) Posse<\/strong>: cont\u00ednua, mansa, pac\u00edfica, com \u201canimus domini\u201d e boa-f\u00e9;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>c) Posse com justo t\u00edtulo (Art. 1.201, par\u00e1grafo \u00fanico, do CC): <\/strong>Justo t\u00edtulo \u00e9 o t\u00edtulo potencialmente h\u00e1bil a transformar o possuidor em dono, mas que n\u00e3o o faz por padecer de um v\u00edcio material ou formal. Exemplos: cess\u00e3o de direitos possess\u00f3rios, compromisso de compra e venda com valor integralmente pago, etc.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Art.<\/strong> <strong>1201. (&#8230;) Par\u00e1grafo \u00fanico<\/strong>. O possuidor com justo t\u00edtulo tem por si a presun\u00e7\u00e3o de boa-f\u00e9, salvo prova em contr\u00e1rio, ou quando a lei expressamente n\u00e3o admite esta presun\u00e7\u00e3o.<\/p>\n<\/div><\/div>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-group is-style-cnvs-block-bordered\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"wp-block-paragraph\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">OBSERVA\u00c7\u00c3O: <\/mark><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Usucapi\u00e3o ordin\u00e1ria \u2013 trabalho (Art. 1.242, par\u00e1grafo \u00fanico, do CC): <\/strong><br><br><strong>Requisitos: <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>a) Prazo: 5 anos; <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>b) Tenha posse-trabalho: <\/strong>\u00e9 aquela<strong> <\/strong>socialmente qualificada \u2013 em que o possuidor utiliza o im\u00f3vel para a sua moradia, bem como que ele fa\u00e7a investimentos de interesse social ou econ\u00f4mico relevante, promovendo a fun\u00e7\u00e3o social da propriedade.<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-group is-style-default cnvs-block-core-group-1754791620881\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<h5 class=\"wp-block-heading has-vivid-red-background-color has-background\" id=\"h-usucapiao-especial-urbana\" style=\"font-size:18px;font-style:normal;font-weight:400\"><span id=\"usucapiao-especial-urbana\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-white-color\">Usucapi\u00e3o Especial Urbana<\/mark><\/strong><\/span><\/h5>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-group is-style-cnvs-block-bg-light\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"wp-block-paragraph\">Possui disposi\u00e7\u00e3o expressa no artigo 1.240 do CC, no artigo 183 da CF e no artigo 9\u00ba da Lei 10.257\/2001 \u2013 Estatuto da Cidade).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Requisitos:&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>a) Prazo: <\/strong>5 anos;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>b) Posse: <\/strong>cont\u00ednua, pac\u00edfica e com <em>\u201canimus domini\u201d<\/em>;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>c) O im\u00f3vel deve ser urbano: <\/strong>situado em zona urbana (crit\u00e9rio de localiza\u00e7\u00e3o dado pela lei municipal, que trar\u00e1 o que considera como zona urbana);&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>d) O im\u00f3vel tem que ter \u00e1rea m\u00e1xima de 250 m\u00b2 de terreno e<\/strong> n\u00e3o de \u00e1rea constru\u00edda. Pode-se construir um sobrado de 400m\u00b2, desde que em um terreno de at\u00e9 250m\u00b2. Al\u00e9m disso, posso tamb\u00e9m usucapir um apartamento de 250m\u00b2, sendo esse limite de \u00e1rea total (\u00e1rea \u00fatil + fra\u00e7\u00e3o ideal do terreno com a fra\u00e7\u00e3o comum do apartamento). Importante apontar que tal metragem deve ser obedecida durante todo o per\u00edodo aquisitivo, n\u00e3o sendo poss\u00edvel usucapir s\u00f3 parte do terreno (Ficava em uma \u00e1rea de 1.000m\u00b2, mas cerquei 250m\u00b2 para pedir a usucapi\u00e3o \u2013 n\u00e3o pode!).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>e) Fins de moradia pr\u00f3pria ou da fam\u00edlia;&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>f) N\u00e3o pode ser propriet\u00e1rio de outro im\u00f3vel durante o per\u00edodo aquisitivo: <\/strong>Pode-se comprar outro im\u00f3vel depois, sem problemas.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>g) Somente pode ser requerida uma \u00fanica vez: <\/strong>mesmo vendendo o im\u00f3vel.
